This document regulates the purchase conditions of the products offered on our website, specializing in sleep apnea therapy.

IMPORTANT WARNING REGARDING MEDICAL DEVICES: Some products in our catalog are medical devices. The purchase and use of these products must be carried out under the recommendation and supervision of a qualified healthcare professional. It is the customer's responsibility to ensure that the product purchased is appropriate for their condition, as prescribed or directed by their physician.

3. Purchase Process

The purchase process is as follows:

1. Select the products and add them to the cart.
2. Review your cart and click on "Checkout".
3. Complete the form with your shipping and billing information.
4. Select your payment method.
5. Accept these Terms and Conditions.
6. Confirm the order.

You will receive a confirmation email with your purchase details.

4. Prices, Taxes and Payment Methods

• Product prices are shown in Euros (€) and include the Value Added Tax (VAT) applicable in Spain.
• Shipping costs are not included in the initial price and will be detailed during the purchase process before final confirmation.
• Accepted payment methods are: Credit/debit card and bank transfer. Payment must be completed for the order to be processed.

5. Shipping and Delivery

• We ship to mainland Spain, the Balearic Islands, the Canary Islands, Ceuta and Melilla.
• The estimated delivery time is 48-72 hours for mainland Spain, 3-5 days for the Balearic Islands, and 5-10 days for the Canary Islands. All times are business days from the date of payment confirmation. This timeframe is an estimate and may vary due to circumstances beyond our control.
• Free shipping on orders over €150.
• Shipping costs will be calculated automatically based on the destination.

6. Right of Withdrawal (Returns)

The customer has a period of 14 calendar days from receipt of the product to exercise their right of withdrawal, without needing to provide justification.

Exceptions to the Right of Withdrawal: For health and hygiene reasons, medical devices or related products (such as masks, tubing, filters, etc.) cannot be returned if their original packaging has been unsealed or opened. These products are delivered in sealed, secure packaging that guarantees their sterility and hygiene. Opening this packaging voids the possibility of return.

To exercise the right of withdrawal for products, the customer must notify us throughdireccion@somnox.com.es  and follow the return instructions. Return shipping costs are the responsibility of the customer.

7. Guarantees

• All new electronic products and therapy equipment sold in our store have a legal guarantee of three (3) years against lack of conformity, in accordance with current Spanish legislation.
• The warranty covers manufacturing defects, but not normal wear and tear, improper handling, or accidental damage.
• To claim under the warranty, please contact us at info@somnox-es.com, indicating your order number and the product defect.

8. Responsibility

The customer agrees to use the purchased products according to the manufacturer's instructions and, in the case of medical devices, under the supervision of a healthcare professional. Somnox is not responsible for the misuse of the products or for any inappropriate diagnosis or treatment by the user.

9. Protection of Personal Data

The processing of our customers' personal data is governed by the provisions of our Privacy Policy, in compliance with Regulation (EU) 2016/679 (GDPR).

10. Applicable Law and Jurisdiction

These terms and conditions shall be governed by and construed in accordance with Spanish law. Any dispute arising from the purchase of products on our website shall be subject to the jurisdiction of the courts of the consumer's domicile.
